Side effects are generally mild and may include dry mouth and a short bout of hiccups. The good news is that post-operative pain is generally greatly reduced or completely absent. Patent Holders, Watch Out!


No matter what happens with the biosimilar legislation, patent holders will have to go through their patent files carefully.

The current generic drug industry was born from the Hatch-Waxman Act of 1984. Among its creations, this Act accounts for a specialized form of patent litigation called Abbreviated New Drug Application (ANDA) litigation. The Act defined an abbreviated approval process for small molecule drugs’ generics; however, it didn’t establish a structure for approving follow-on biologics, known as biosimilars and generic biologics. The US Congress is now studying legislation to create such a structure. If this legislation is ratified, it will most probably create a patent litigation structure very different from the ANDA form.

Through modern technologies, biologic drugs are isolated from living matter or produced in living cells. Biologics vary from small molecule drugs in various ways related to safety and product variability, aspects that are critical for the definition of an approval process for follow-on biologics:

-They are large and complex molecules or mixes of molecules.

-They are produced in living cells, offering great potential for greater variability based on the precise host cells or organisms used to create them, the growth conditions for culturing them, and the purification methods employed to isolate the biologic from contaminants.

-They show distinctive safety issues, like the possibility of producing negative immune responses.

Biologics are so complex and variable that it is difficult to define an approval process. These characteristics prevent the implementation of a therapeutic equivalence standard similar to the one used for small molecule generic drugs in the Hatch-Waxman Act. As an alternative, the standards of biosimilarity and interchangeability in HR 1427 and HR 1548 are proposed.

HR 1427 defines biosimilar as “no clinically meaningful difference between the biological product and the reference product would be expected in terms of safety, purity, and potency if treatment were to be initiated with the biological product instead of the reference product”. HR 1548 requires that a follow-on biologic candidate exhibits biosimilarity “based upon data derived from: analytical studies that demonstrate that the biological product is highly similar to the reference product, from animal studies, and from clinical studies that are sufficient to demonstrate safety, purity and potency”.

In regards to interchangeability, both HR’s agree in that the biological product should be biosimilar to the reference one, and that the patient should go from one to the other without risk.

The similarity standards proposed pose new issues for patent litigations because there is no requirement that the follow-on biologic should be identical to the reference product. Follow-on biologic candidates can say that their biologic doesn’t infringe any patents covering the reference product or its manufacturing process, and generic manufacturers may obtain approval on the basis of biosimilarity or interchangeability: it gives the same results but is different enough. In addition, the manufacturer will probably try to make the product in a different way from the patented process, creating concerns about the follow-on biologic not being truly biosimilar or interchangeable. It will certainly be a challenge for the reference product manufacturer to protect its investment.

In chain reaction, these possibilities will increase litigation costs, due to testing and characterization of the biologics, inspections of sites, and declarations of those involved. There will be lots of pharmaceutical consulting for sure.

Proposed FDA CGMP Regulations Impact Pharmaceutical and Biotech Industries

The biotech and pharmaceutical industries face new changes with proposed rules concerning cGMP (current good manufacturing practice) for combination products. The cGMP proposal (74 Fed. Reg. 48,423) by the FDA’s Office of Combination Products (OCP) won’t create brand-new requirements. However, this proposed rule clarifies confusion applied to devices, drugs and biological products that are used to create combination products. Pharmaceutical consulting firms state that 300 manufacturers will be affected by this new regulation proposal.

What Defines a Combination Product?

A combination product is a product combined with two or more FDA components. FDA regulates drugs and devices under FDCA (Federal Food, Drug, and Cosmetic Act). Biological products are placed under section 351 of PHS Act (Public Health Service Act). HCT/Ps are found under section 361 of the PHS Act.

These FDA regulated components include the following:
• Drugs
• Biologics (i.e. blood/blood components)
• Medical devices
• Human cell or tissue products (also known as “HCT/Ps”)

Combination products are described as:

• Physically combined during manufacturing - reates single entities or two separate component in the same package – also known as “co-packaging”

• Cross labeled - Components are manufactured separately and packaged (but labeled specifically for use with another product)

Clarification of cGMP Requirements

According to the FDA, each product has separate cGMP regulations. When products are combined together, confusion occurs as to which regulations apply to products when they are combined.

These new OCP regulations concerning combination products would clarify the following issues:

• Reduce confusion regarding cGMP requirements applied to combination products
• Ensure consistency with applications and enforce necessary requirements

The biggest issue with combination products is when constituents are combined in co-packaging or single entities. Overall, these revised regulations streamline options – avoids establishing duplicate drug and device quality systems.

The FDA reports that compliance with these cGMP regulations would not add extra burdens on manufacturers, and would actually reduce the paperwork hassle associated with co-packaged and single-entity combination products.

In 2004, the OCP issued draft guidance but never finalized it. Instead of finalizing the original draft guidance, the OCP decided to write new regulations that are similar to the proposed draft guidance.

The FDA plans to follow necessary administrative processes. They will finalize comments by the end of December 2009, and make these new regulations effective 180 days from its publication date. These new rules will ease the confusing issues that both the pharmaceutical and biotech industries have concerning combination products.

Sample Sections of Proposed Regulations

• Sec 4.3. – Identifies drug cGMP regulations which applies to drug constituents of combination products. (i.e. QSR for devices). It also applies cGMP regulations of constituent parts for combination products created by cross labeling.

• Sec 4.4. – FDA states that constituent parts of combination products retain regulatory stats (drugs or devices), even after parts are combined. Also, cGMP requirements continue to apply to each constituent part – whether they are in a co-packaged product or physically combined in single entities. The manufacturer adheres to cGMPs for drug constituents and QSR for device constituents.

The Future of Cartilage Regeneration by Stem Cells...

The success of tissue engineering for cartilage for conditions like osteoarthritis will be dependent on the interactions between the cells, the matrix, and mechanical forces directed against the joint.

It has become increasingly clear that the mechanical environment is equally important as, and synergistic with, the chemical environment in directing cell behavior.

Signaling pathways spurred on in response to mechanical (load-bearing) forces are essential for the maintenance and function of tissue cellular function. Load-bearing soft tissues such as tendons and cartilage which consist of a network of fibrous protein (predominantly collagen and elastin), embedded in a gel of proteoglycans, glycosaminoglycans and glycoproteins exhibit specific properties of tissue biomechanics and subsequent cellular responses.

Investigations in these unique tissues and engineered are rapidly expanding our understanding of a new area of medicine called mechanobiology.

Successful tissue engineering requires a comprehensive understanding of mechanobiology and in particular the loading conditions experienced by the cells under physiological conditions, in order to establish how this controls cellular functions.

Clarification of mechanical pathways should provide useful information for tissue engineering and regenerative applications as well as further insight into mechanisms involved in disease processes.

The population of the Western world is aging. As a direct consequence, there will be an increase in diseases that can be associated with aging, such as joint problems.. The underlying idea is that nanometer structure matches with the natural extracellular matrix resulting in an improved interaction of the tissue-forming cells compared with conventional biomaterials. Recent developments in the field of nanotechnology offer powerful tools to modify the surface of biomaterials by introducing artificial mapping and specific surface chemistry on the material. It is well-known that both topography and surface chemical composition affect the reactions of the biological environment to the device.

Human mesenchymal stem cells occupy a particular stem cell niche, and consist of those stem cells that can differentiate into cells of mesenchymal tissues, including osteoblasts, adipocytes and chondrocytes.

Osteoarthritis is the most common musculoskeletal disorder and causes a significant social and psychological drain on those affected as well as those who care for them; in addition it leads to significant economic costs. This disease is characterized by articular cartilage degeneration and damage to the underlying subchondral bone. To date, there is a lack of effective therapies to treat the disease, resulting in total joint arthroplasty (joint replacement surgery) as the only viable therapeutic option. Thus, there is a need to develop methods that are less invasive and capable of regeneration of articular cartilage.

The use of autologous chondrocytes in tissue engineering applications promises an avenue in terms of efficacy and safety resulting in mesenchymal stem cells (MSCs) being considered an ideal therapeutic candidate for cartilage repair. MSCs acting through multiple growth mechanisms are also known to prevent OA progression after injection into the joint.

The Exciting and Future Role of Stem Cells in the Health Industry

As the debate on whether to use stem cells, or not to use stem cells continues to rage, many people are starting to look to the potential upside of using stem cells as a deciding factor. Stem cells have remarkable potential to be used to test new drugs, cure previously thought of as incurable diseases, and possibly cure many different types of cancer. Regardless of the debate over stem cell research, the practical usage of stem cells could ultimately be revolutionary in the field of medicine. Stem cells could be used to test new drugs, they would allow for a wider range of drug testing for all kinds of drugs, including anti-tumor drugs in cancer cases. They can be used to regenerate damaged cell tissue or even completely replace damaged tissue in the body. It could help in the treatment, or possibly cure such diseases as Alzheimer’s disease, Crohn’s disease, diabetes, strokes, spinal cord injuries, severe burns, and heart disease. Only time will tell what the future use of stem cells will bring to our society as a whole, but at this point many are seeing the possible, future benefit of using stem cells, outweighing any negative stigma regarding stem cell research.

I'm a board-certified family physician and I'm one of the happiest physicians in America. Once I was so depressed that I dreamed of giving up medicine and returning to my college waitressing job. The center features yoga, massage therapy, counselors, and a solar-heated, wheelchair-accessible indoor pool/hot tub. The office, just a covered walkway from the pool, feels more like a living room with comfortable chairs, pillows and fun flannel gowns.

How does it work? With no staff I answer the phone and complete administrative tasks at my home business office. House calls and same day appointments are always available. Patients are seen three days a week at the community clinic and I'm accessible 24/7 by phone.

How are we funded? Malpractice insurance is cut in half because I work part-time. With no staff and a small office ($322/month), my reduced overhead allows leisurely thirty to sixty minute office visits. I bill most insurance and uninsured receive a 40% discount and have the option of bartering. I accept dog care, carpentry, home-baked bread, and almost anything else patients offer. Most importantly, nobody is ever turned away for lack of money.

Thanks to my community, I love being a doctor. When patients arrive, I smile and greet them at the door. On random patient-appreciation days, they receive chocolates and smiley-face balloons.
